Please read these terms carefully before using ApexaRank. They govern your access to and use of our platform.

These Terms of Service ("Terms") form a legally binding agreement between you (or the organization you represent) and ApexaRank, Inc. ("ApexaRank", "we", "us", or "our"). By creating an account or using our services, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using ApexaRank's platform, website, APIs, or any related services (collectively, "Services"), you confirm that you are at least 18 years old, have the authority to enter into these Terms (on behalf of yourself or an organization), and agree to be bound by them.

If you do not agree with these Terms, you must not use the Services. We reserve the right to update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

Description of Services

ApexaRank is an AI visibility intelligence platform that allows businesses to monitor and improve their brand presence across AI-powered platforms including ChatGPT, Perplexity, Gemini, Google AI Overviews, Microsoft Copilot, and others.

Our Services include:

AI Visibility Reports showing how your brand performs across monitored prompts and platforms.

Prompt Tracking to monitor questions relevant to your industry and brand.

Competitor Intelligence showing where competitors appear in AI-generated answers.

Citation Tracking identifying pages used as sources by AI platforms.

Content Intelligence providing recommendations for new and improved content.

Action Plans with step-by-step implementation tasks for your teams.

AI Discoverability Checks reviewing technical signals affecting AI crawler access.

We may update, modify, or discontinue features at any time. We will provide reasonable notice for material changes that affect your use of the Services.

Account Registration

To use ApexaRank, you must create an account. You agree to:

Provide accurate, current, and complete information during registration.

Keep your account credentials confidential and not share them with unauthorized parties.

Notify us immediately of any suspected unauthorized access to your account.

Be responsible for all activity that occurs under your account.

Not create accounts under false pretenses or for the purpose of abusing the Services.

You may not use another user's account without their permission. ApexaRank is not liable for any loss resulting from unauthorized use of your account.

Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

Use the Services to violate any applicable local, national, or international law or regulation.

Attempt to gain unauthorized access to any part of the platform or its related systems.

Reverse engineer, decompile, or attempt to extract source code from the Services.

Use automated tools (bots, scrapers) to access or extract data from the Services beyond what is permitted by your subscription plan.

Transmit any harmful, offensive, or disruptive content through the platform.

Use the Services to infringe the intellectual property rights of others.

Resell, sublicense, or redistribute access to the Services without our written permission.

Interfere with the operation or performance of the Services or servers hosting them.

Violation of acceptable use policies may result in immediate suspension or termination of your account without refund.

Intellectual Property

ApexaRank's IP: All content, features, technology, software, trademarks, logos, and design elements of the Services are owned by ApexaRank or its licensors. Nothing in these Terms grants you a right to use our intellectual property other than as expressly permitted.

Your IP: You retain all rights to the websites, brand names, content, and data you input into the Services ("Your Content"). By using the Services, you grant ApexaRank a limited, non-exclusive license to process Your Content solely to provide the Services to you.

Reports and outputs: AI visibility reports, action plans, and other outputs generated for your account are licensed to you for your own internal business use. You may not redistribute or resell these outputs without our written consent.

Payment & Subscriptions

ApexaRank offers subscription plans with different feature sets and usage limits. By subscribing, you agree to the following:

Billing: Subscriptions are billed in advance on a monthly or annual basis. Charges are non-refundable except where required by law.

Auto-renewal: Subscription renews automatically unless cancelled before the renewal date.

Price changes: 30 days' notice given before any price increase; applies at next renewal.

Cancellation: You may cancel at any time through your account settings. Access continues until the end of the current billing period.

Free trials: No charge until the trial ends; cancel anytime during the trial at no cost.

Failed payments: Account may be suspended; we'll notify you by email before any suspension.

Your Data

You own the data you input into ApexaRank. We process it only to provide and improve the Services, as described in our Privacy Policy. We do not sell your data or use it to train AI models.

You are responsible for ensuring that any data you submit does not violate the rights of third parties or any applicable laws. Upon account termination, we will delete or return your data as described in the Privacy Policy.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

The Services will be uninterrupted, error-free, or completely secure.

AI platform behaviors or rankings will change as a result of using our recommendations.

Data from AI platforms will be 100% accurate or complete at all times.

Results from using our action plans will meet any specific business objectives.

AI platforms (ChatGPT, Perplexity, Gemini, etc.) are independent services not affiliated with ApexaRank. Their behavior, algorithms, and outputs may change without notice.

Limitation of Liability

To the fullest extent permitted by law, ApexaRank and its directors, employees, partners, and licensors shall not be liable for any:

Indirect, incidental, special, consequential, or punitive damages.

Loss of profits, revenue, data, business opportunities, or goodwill.

Damages arising from your use of or inability to use the Services.

Unauthorized access to or alteration of your data.

In any case, ApexaRank's total liability to you for all claims arising from these Terms or your use of the Services shall not exceed the amount you paid to ApexaRank in the 12 months preceding the claim.

Termination

Either party may terminate the agreement at any time. You may terminate by cancelling your subscription and ceasing use of the Services. We may terminate or suspend your access if you violate these Terms, fail to pay, or for any other reason with reasonable notice.

Upon termination, your right to access the Services ends immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

Governing Law

These Terms shall be governed by applicable laws. Any disputes arising from these Terms or your use of the Services will be handled in good faith between both parties.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
